Our DMCA Policy

CapCutModIndia.in respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA) and analogous provisions of the Copyright Act, 1957 (India), we will respond expeditiously to claims of copyright infringement committed using our website.

Please note: CapCut Mod India is not affiliated with ByteDance. All content related to “CapCut” on this website is used purely for informational, educational, and nominative fair use purposes.

Requirements for a Valid DMCA Notice

To be valid and actionable, your DMCA takedown notice must include all of the following:

1. Your identity: Full legal name, company name (if applicable), email address, and phone number
2. Your authority: A statement that you are the copyright owner or authorised to act on behalf of the copyright owner
3. Description of the copyrighted work: A clear description or a link to the original copyrighted material being infringed
4. Infringing content location: The exact URL(s) on our website where the allegedly infringing material is located
5. Good faith statement: “I have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law”
6. Accuracy statement: “The information in this notification is accurate, and, under penalty of perjury, I am authorised to act on behalf of the owner of the exclusive right that is allegedly infringed”
7. Electronic or physical signature of the person authorised to act on behalf of the copyright owner

Takedown Process

Once we receive a valid DMCA notice, we will:

1. Acknowledge receipt of your notice within 24 hours
2. Review the notice for completeness and validity within 48 hours
3. If valid, remove or disable access to the allegedly infringing content
4. Notify the user who submitted the relevant content (if identifiable) of the takedown
5. Send you written confirmation once the content has been removed

For urgent or commercial DMCA requests, you may also reach our legal team directly at dmca@capcutmodindia.in. Please include “URGENT DMCA” in the subject line.

Counter-Notice Procedure

If you believe that content you submitted was removed due to a mistake or misidentification, you may submit a counter-notice to dmca@capcutmodindia.in. A valid counter-notice must include:

1. Your full name, address, phone number, and email address
2. Identification of the removed material and the URL where it appeared before removal
3. A statement under penalty of perjury that the material was removed by mistake or misidentification
4. Your consent to the jurisdiction of the appropriate court in India
5. Your electronic or physical signature

Upon receiving a valid counter-notice, we will notify the original complainant. If they do not initiate legal action within 10 business days, we may restore the removed content at our discretion.

Repeat Infringer Policy

In accordance with DMCA requirements, CapCutModIndia.in maintains a repeat infringer policy. Users who are found to have repeatedly infringed intellectual property rights will have their access terminated. We reserve the right to terminate access at our discretion for any infringement.

Fair Use Consideration

Before submitting a DMCA notice, please consider whether the use of your content may qualify as fair use (U.S.) or fair dealing (India) under applicable copyright law. Factors considered include:

• Purpose and character of the use (commercial vs. educational)
• Nature of the copyrighted work
• Amount and substantiality of the portion used
• Effect of the use on the potential market for the original work
